Mediation, arbitration or a lawsuit: what is the difference?
Mediation and arbitration at the agency, damage relief at the Korea Consumer Agency and a civil lawsuit are separate routes, and a lawsuit can be filed without going through mediation first.
Korea Patient Rights Guide does not say which route is better. The table lists what the law sets for each so you can ask the right body.

How do the medical dispute routes compare?
They differ in who runs them, whether the other side must take part and what the result means legally.
| Route | Run by | How it starts | Legal time frame | Effect of the result |
|---|---|---|---|---|
| Mediation | Korea Medical Dispute Mediation and Arbitration Agency | Respondent agrees within 14 days, or automatic start for death, coma or severe disability | Decision within 90 days of commencement, extendable once by 30 days | If both sides accept: same effect as a court settlement (Medical Dispute Mediation Act, Art. 36) |
| Arbitration | Same agency (mediation panel) | Both sides agree in writing to follow the panel’s final decision; can be requested during mediation | Set by the act and the Arbitration Act | Award has the same effect as a final court judgment (Art. 44) |
| Consumer damage relief | Korea Consumer Agency and its Consumer Dispute Mediation Committee | Damage relief application by the consumer | Referred to the committee if no agreement within 30 days (medical cases can be extended up to 60 days); committee decides within 30 days | If both sides accept the committee’s mediation: same effect as a court settlement (Framework Act on Consumers, Art. 67) |
| Civil lawsuit | Court | Filing a claim; mediation is not required first (Art. 40) | No time frame set by the mediation act | Final judgment |
Do you have to try medical dispute mediation before suing?
No. A lawsuit on a medical dispute can be filed without going through mediation (Art. 40).
Can you use medical dispute mediation and a lawsuit at the same time?
No. The agency dismisses an application if a lawsuit on the same matter was already filed, and also if one is filed after applying (Art. 27(3), (7)).
The same applies to the Korea Consumer Agency’s Consumer Dispute Mediation Committee: the agency dismisses an application if the matter was already filed with that committee, unless it was withdrawn or dismissed before (Art. 27(3)). The consumer agency in turn excludes cases already filed with a specialist mediation body such as the agency (Framework Act on Consumers, Art. 35(2)).
If a lawsuit is filed after applying, the agency’s fee page says the fee is not refunded.
Which medical dispute routes give a binding result?
A concluded mediation and an accepted consumer committee mediation have the effect of a court settlement; an arbitration award and a court judgment have the effect of a final judgment.
Mediation, the consumer committee and arbitration are not public by default; a court hearing generally is. Time frames also differ: the mediation and consumer laws set deadlines for a decision, while the mediation act sets none for a lawsuit. Korea Patient Rights Guide does not publish average durations until it has the yearbook figures.
What else do people ask about medical dispute mediation or lawsuit?
Is mediation faster than a lawsuit in Korea?
The act requires a mediation decision within 90 days of commencement, extendable once by 30 days. There is no comparable deadline for a lawsuit in that act, and average durations are not shown until the statistics are collected.
Can I go to court after mediation fails?
Yes. Watch the limitation period; the interruption from the application lapses unless a lawsuit is filed within a month of withdrawal or dismissal.
Can I file with the consumer agency and the mediation agency at once?
No. Each excludes cases already filed with the other.
Does Korea Patient Rights Guide recommend a lawyer?
No. It does not refer lawyers, claims adjusters or institutions.
Is a criminal complaint one of these routes?
Criminal proceedings are outside the scope of Korea Patient Rights Guide, which covers civil and administrative routes only.
